MAE&CO.STUDIOS
PHOTOGRAPHY SERVICES AGREEMENT, TERMS & PRIVACY POLICY
Effective date: ___October 18, 2026_______________
This Photography Services Agreement (“Agreement”) governs photography services provided by Mae&Co. Studios (“Photographer”) to the individual or individuals booking a session (“Client”). By submitting a booking request, accepting a quote, paying a booking fee, or otherwise agreeing to services, the Client agrees to the terms that apply to their booking. The Photographer will make this Agreement available before the Client commits to a booking or payment.
-
The session type, date, location, package, included images, price, and any special arrangements will be confirmed in a written contract before the session.
A booking is not confirmed until the Photographer has accepted it and any required booking payment has been received. Submission of an inquiry alone does not guarantee a reservation.
The client is responsible for providing accurate contact information and communicating relevant preference, accessibility needs, and session requirements in advance.
-
The Client agrees to pay the price disclosed and accepted at booking. Any deposit, retainer, booking fee, payment deadline, remaining balance, applicable taxes, and additional charges will be stated in the booking confirmation or invoice.
Additional services, extra images, prints, extended coverage, or other items outside the agreed package require disclosure of the applicable charge before the Client agrees to purchase them.
The Photographer will not impose undisclosed fees or change an agreed price without the Client’s agreement, except where permitted by applicable law.
-
The Client should notify the Photographer as soon as possible if they need to cancel or reschedule.
Rescheduling is subject to availability. Any booking fee or retainer will be handled according to the cancellation terms disclosed before payment and applicable law. No fee will be treated as automatically nonrefundable merely because it is called a deposit or retainer.
If the Photographer cancels, the Photographer will make reasonable efforts to offer an alternative date. If the services cannot be provided, the Photographer will refund payments for services not performed, subject to applicable law and any lawful written agreement.
For weddings and events, any separate cancellation schedule, payment milestones, coverage requirements, or special arrangements must be provided in writing before booking.
-
The Client agrees to arrive on time, follow reasonable session instructions, and treat the Photographer and other participants respectfully.
The Client is responsible for securing permission for any location they select or arrange, unless otherwise agreed in writing.
The Photographer may pause, modify, or end a session if there is unsafe conduct, harassment, a serious breach of agreed boundaries, or a genuine safety concern. Any financial consequences will be handled according to the agreed terms and applicable law.
For group sessions, the Client should ensure that participants know the nature of the session and that any required permissions have been obtained.
-
The Client acknowledges that photography involves artistic judgment. The Photographer retains creative control over composition, lighting, posing, editing, and selection of final images.
The Photographer will make reasonable efforts to accommodate preferences discussed before the session, but cannot guarantee a particular expression, pose, background, weather condition, or photographic result.
Unedited RAW files, rejected images, and outtakes are not included unless expressly agreed in writing.
-
The final images will reflect the Photographer’s established editing style. The number of delivered images and the expected delivery timeframe will be stated in the selected package or booking confirmation.
Images will generally be delivered digitally through an online gallery or another agreed method unless physical products are included.
The Client is responsible for downloading and backing up delivered files. Gallery access may expire after a period disclosed to the Client.
The Photographer will make reasonable efforts to safeguard image files but cannot guarantee that digital systems will never experience failure, corruption, or interruption.
-
Copyright in photographs created by the Photographer remains with the Photographer as provided by law.
After payment in full, the Client receives a personal-use license to download, print, and share delivered images for noncommercial purposes. The Client may not sell the images, claim authorship, use them in commercial advertising, or materially alter them in a way that misrepresents the Photographer’s work without written permission.
Commercial licensing or expanded usage rights must be agreed upon separately in writing.
-
For standard photography sessions, Mae&Co. Studios intends to use selected photographs for business promotion, including its website, portfolio, social media accounts, sample galleries, advertisements, and marketing materials.
This policy will be clearly presented to the Client before booking. Where legally sufficient, the Client’s affirmative acceptance of this Agreement will serve as permission for the promotional uses described in this section.
The Photographer will not knowingly use photographs in a misleading, defamatory, unlawful, or materially deceptive manner. The Photographer will not imply that a Client endorses a third-party product or service without appropriate authorization.
Promotional use does not transfer copyright ownership to the Client or grant the Client ownership of the Photographer’s marketing materials.
This section does not override the separate protections for boudoir sessions, minors, or other circumstances requiring specific consent under applicable law.
-
The privacy of clients participating in boudoir or intimate photography is especially important.
Photographs from boudoir or intimate sessions will not be published or used in public marketing, social media, portfolios, websites, advertisements, or promotional galleries without the Client’s separate, explicit authorization covering the intended use.
Booking a boudoir session does not, by itself, authorize publication of intimate images. The Photographer will respect the Client’s stated boundaries and privacy preferences.
The Client may request a pause or end the session at any time. Only adults legally able to participate in the agreed session may book boudoir or intimate photography.
-
A parent or legal guardian must provide the permissions legally required for a minor’s photography session and any use of the minor’s image.
Photographs of minors will not be used for public promotional purposes without separate, informed permission from the minor’s parent or legal guardian. Where appropriate or required by law, the minor’s own assent will also be sought.
The Photographer will not knowingly publish a minor’s private or sensitive information alongside images. Any required consent must cover the intended use and comply with applicable law.
-
The Photographer will take reasonable steps to protect client photographs and personal information from unauthorized access or disclosure.
Photographs delivered through an online gallery may be accessible to anyone with the gallery link or credentials, depending on the platform’s settings. Clients should avoid sharing private gallery links with unintended recipients.
Once a photograph is lawfully published online with authorization, third parties may copy, screenshot, share, or redistribute it. The Photographer cannot guarantee that third parties will not do so and cannot guarantee the removal of copies posted by others.
The Photographer will not knowingly disclose confidential booking information for unrelated purposes and will handle personal information in accordance with applicable law.
-
For weddings, events, and group sessions, the Client should provide a schedule, relevant contact details, venue restrictions, and any priority images in advance.
The Photographer will make reasonable efforts to capture important moments but cannot guarantee every requested photograph because of timing, guest behavior, lighting, access restrictions, or other circumstances beyond the Photographer’s reasonable control.
The Client is responsible for communicating relevant photography arrangements to event participants and for obtaining any permissions required for private or restricted locations.
The general promotional-use policy remains subject to the specific-consent requirements for minors, boudoir sessions, and other protected circumstances.
-
Sessions may be postponed, relocated, or modified due to dangerous weather, unsafe locations, venue restrictions, illness, or other circumstances that make photography impractical or unsafe.
The Photographer will communicate changes as soon as reasonably possible and work with the Client to determine an appropriate alternative.
Neither party is required to proceed under unsafe conditions.
-
The Photographer will take reasonable precautions to protect equipment and image files.
If serious equipment failure, file loss, illness, or another unforeseen event prevents delivery of some or all agreed services, the Photographer will notify the Client and make reasonable efforts to provide an appropriate remedy, which may include rescheduling or a refund for services not performed
-
Each party remains responsible for its own acts and omissions as required by law.
Nothing in this Agreement releases either party from liability for fraud, willful misconduct, gross negligence, or other liability that cannot legally be waived or limited.
This Agreement is governed by the laws of North Carolina, to the extent applicable. Any provision found unenforceable will be interpreted or severed as necessary without invalidating the remaining lawful provisions.
-
This Agreement, together with the accepted booking confirmation, invoice, and any signed addenda, constitutes the agreement between the parties concerning the booked services.
Any changes must be communicated in writing and accepted by both parties. If a specific written booking term conflicts with this general Agreement, the parties should resolve the conflict in writing before the session.
Nothing in this Agreement waives rights that cannot legally be waived.
-
By affirmatively accepting this Agreement before booking, the Client confirms that they have had an opportunity to review the terms, ask questions, and understand the policies that apply to their session.
The Client acknowledges that the standard promotional-use policy is disclosed in advance and that separate authorization is required for boudoir or intimate images and for promotional use of images of minors.
